Definitions

For the purposes of these Terms and Conditions:
Country refers to: Australia
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Blue Knot Foundation, Level 1, 1 James Place, North Sydney NSW 2060.
Device means any device that can access the Service such as a computer, a mobile phone or a digital tablet.
Goods refer to the items offered for sale on the Service.
Orders mean a request by You to purchase Goods from Us.
Service refers to the Website.
Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
Website refers to Blue Knot Community website, accessible from https://www.blueknot.org.au/
You mean the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of WooCommerce and the agreement that operates between you and Blue Knot Foundation. These Terms and Conditions set out the rights and obligations of all users regarding the use of the WooCommerce and should be read in conjunction with the Terms and Conditions for the use of our website. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms and Conditions, then you may not access the Service.

Your access to and use of the Service is also conditioned on your acceptance of and compliance with the Privacy Policy of Blue Knot Foundation. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of your personal information when you use the Service or the Website and tells you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using our Service.

Placing Orders

By placing an Order for Goods through WooCommerce, you warrant that you are legally capable of entering into binding contracts.

Your Information

If you wish to place an order for Goods available on the Service, you may be asked to supply certain information relevant to your Order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that:

  1. You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that
  2. (ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of your Order.

Order Cancellation

We reserve the right to refuse or cancel your Order at any time for certain reasons including but not limited to:

  • Goods availability
  • Errors in the description or prices for Goods
  • Errors in your Order

Blue Knot Foundation makes no guarantee for the availability of the items listed for sale on our website. By submitting an order, you are agreeing that you will not hold us liable for any loss or damage, whether indirect or direct, as a consequence of the unavailability of our products.

We reserve the right to refuse or cancel your Order if fraud or an unauthorised or illegal transaction is suspected.

Your Order Cancellation Rights

Blue Knot Foundation does not provide refunds for changes of mind. If you change your mind before an order is dispatched, Blue Knot may at its absolute discretion, cancel and refund your order. If your item is damaged or defective, you may be entitled to a refund, replacement, or repair.

If you need to return a product, please contact [email protected] or call 02 8920 3611 and provide proof of purchase, your name, contact number, details of the item being returned and the reason for your return. If your product is damaged, we may ask you to provide evidence of the condition of the product e.g. photo or return of the item.

We may offer you a refund when

  • Your order is no longer available, or a product is out of stock
  • The item you received is damaged

Prices Policy

Blue Knot Foundation reserves the right to revise its prices at any time prior to accepting an Order. The prices quoted may be revised by Blue Knot Foundation subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, you will have the right to cancel your order.

Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, via online payment methods (PayPal and Stripe, for example). All prices are listed in Australian Dollars inclusive of GST. Nothing in this policy is deigned or intended to replace consumer rights under Australian Consumer Law. Shipping and delivery

Orders are despatched via Australia Post. The estimated delivery times are determined by the type of shipping. All deliveries are sent using tracking. All orders will be dispatched between Monday and Friday. We aim to dispatch all orders within 5 working days of placing an order. If there are any delays in processing your order you will be notified within 3 working days of the delay, provided with an explanation and ETA for dispatch. You may also choose to cancel your order and get a refund if the ETA is not suitable to you.

Incorrect or incomplete delivery information

If you provide incorrect or incomplete delivery information on your order this may result in a delayed delivery, lost parcel or your parcel being returned to Blue Knot. If your delivery is delayed or lost because you provided incorrect information Blue Knot Foundation will not replace or a refund the items. If your delivery is returned to Blue Knot Foundation because you provided incorrect information, Blue Knot will charge you another shipping fee to dispatch your order. Blue Knot will only provide a refund in instances in which the order returned to us is in an acceptable condition. In instances in which Blue Knot Foundation is responsible for shipping your order to the incorrect address (an address different to the one on your order), we will organise a replacement to be sent to you at no extra cost.

Photography

Images displayed on our website are a guide only and are not a guarantee of the look or colour of a product. Images may be cropped or altered to display on screens and show details of items. From time-to-time we update our catalogues and offerings and the most current version may not be displayed in the image you see in the online store.

International Orders

All overseas orders are charged in Australian Dollars and will be shipped as one parcel. International shipping will be individually calculated at checkout. We aim to dispatch international orders within 5 working days but on occasions this may take up to 10 working days. Depending on the value of your order, additional taxes or fees may be applicable at the port of entry in your country. Blue Knot Foundation is not responsible for these fees and will not reimburse customers for any such fees. Nor will we will provide a refund for items that customers have purchased in such instances.

Governing law

By submitting an order, you understand and agree that you are subject to the laws of New South Wales.
